New insurance policy to help support club officers and directors of affiliated clubs

A new liability insurance policy has been taken out to provide additional cover and protection for people involved in athletics as an officer or director of an affiliated athletics club.

This new policy recognises the valuable role these people, who are often volunteers, have to play in the sport and the importance of giving them confidence and support in fulfilling their roles in the sport.

 

The new policy has been taken out in the name of UKA and the four home country athletics federations including England Athletics to cover their clubs’ officers and directors.

 

Committee members of affiliated clubs may act in the capacity of a director, company secretary, trustee, non-executive director or other similar ‘officer’ role. These are positions of trust and individuals must act accordingly. They can be liable for any act which is negligent, outside their authority, or in breach of duty or trust. Individuals acting in such a role are potentially placing their personal assets at risk if an allegation is made that they have failed to use reasonable care and skill in executing their duties. Even if a legal action is successfully defended it may still involve incurring significant legal fees.

This is why it was felt it was important to take out this specific policy in addition to the other insurance policies already in place.

The new insurance policy for Directors & Officers Liability which applies to affiliated clubs provides cover against legal defence costs and expenses and settlements or damages awarded against insured persons for which they are personally liable for an actual or alleged Wrongful Act including:

  • breach of duty or trust

  • neglect, error or omission

  • misrepresentation, misstatement or misleading statement

  • any other matter claimed against an Insured person whilst acting in such capacity

 

The people covered by this insurance include:

  • past, present and future trustees, committee members, directors, officers, de facto directors and outside directors

  • spouses, heirs, estates and legal representatives of deceased directors and officers where they are pursued as part of a claim against an insured person.

  • Employees in a managerial or supervisory capacity
